Ja, ik weet dat Marokkanen van zwartgallige humor houden en dat ze humor gebruiken om trauma's en sociale onrecht te verwerken.

Ik weet ook dat het makkelijk is om zogenaamde sarcastische posts te plaatsen op dit forum veilig achter je pc in Holanda.

Maar ik kan niet begrijpen waarom iemand die zich tot de bewuste Imazighen rekent zulke "grapjes" durft te maken over een persoon die zich juist inzet voor de bewustwording van Imazighen in Marokko en van wie nu duidelijk is geworden dat hij 3 jaar van zijn leven moet inleveren + 80.000 moet dokken. Ik denk ook niet dat Chakib hierom kan lachen, noch zijn familie en noch zijn kennissen.

De Marokkaanse rechtbank in Casablanca heeft gisteren de Riffijnse mensenrechtenactivist Chakib al-Khayari veroordeeld tot drie jaar gevangenisstraf wegens 'belediging van het koninkrijk Marokko' en illegaal storten van geld op buitenlandse rekeningen. Khayari werd opgepakt na kritiek op de wijze waarop de autoriteiten waren opgetreden in een grootscheepse operatie tegen hasjproductie en -smokkel richting Europa vanuit de Rif. Volgens Khayari waren vooral de minder belangrijke handelaren aangepakt. Hij zei dat de 'staatsinstellingen' die bij de hasjhandel zijn betrokken buiten schot bleven.
De zaak tegen Khayari raakt in het bijzonder de relatie tussen Marokko en Spanje. Marokko beschuldigde de activist te zijn omgekocht door de Spaanse inlichtingendienst CNI. Volgens het onderzoek dat in de rechtszaak werd gepresenteerd waren de "verklaringen aan de buitenlandse pers dat de Marokkaanse autoriteiten geen enkele moeite doen in de strijd tegen de drugs gedaan op verzoek van twee diplomaten van de CNI".
Marokko neemt het veronderstelde in diskrediet brengen van de acties tegen de drugsteelt en -handel hoog op. Daarbij groeit de irritatie over de opstelling vanuit de Europese Unie, die voor Marokko veruit de belangrijkste afzetmarkt voor hasj is.
Het dagblad El País meldt vandaag dat de vestiging van de Spaanse inlichtingendienst in de Rif deze maand wordt gesloten. Voor Spanje geldt dit als een gevoelige klap. De noordelijke zone tussen Tetuan en Ceuta staat bekend als de uitvalsbasis van geradicaliseerde moslimactivisten.

Case Violates Freedom of Expression, Undercuts Government’s Reformist Image

(New York) - The sentencing today of the human rights activist Chekib el-Khayari to three years in prison is a stark reminder of Morocco's tenuous and uneven progress on human rights, Human Rights Watch said. El-Khayari, who had criticized public officials for alleged complicity in drug-trafficking, was convicted of "gravely insulting state institutions," and of minor violations of regulations governing foreign bank accounts and currency.

El-Khayari is president of the Association for Human Rights in the Rif, an independent organization based in the Mediterranean coastal city of Nador. Before his arrest on February 17, 2009, el-Khayari had made numerous statements on drug-trafficking from northern Morocco to Europe, both to the international media and in conferences in Europe, accusing some officials of complicity in the trade or laxness in combating it. El-Khayari is also an activist for Amazigh (Berber) rights and has spoken out against mistreatment of migrants and abuses by both Moroccan and Spanish security forces at the border with the Spanish enclave of Melilla. All of these factors make the Rif region a sensitive issue in Morocco.

"Morocco is opening up in some respects, but its treatment of Chekib el-Khayari shows that when someone speaks out in ways that truly bother officials, they come down on him like a ton of bricks," said Sarah Leah Whitson, Middle East and North Africa director at Human Rights Watch.

Judge Jamel Serhane of the Casablanca Court of First Instance convicted el-Khayari of "gravely insulting state institutions" for his criticism of the state's record in policing the drug trade. The judge also convicted him of violating regulations concerning the opening of a bank account abroad and the importing of foreign currency into Morocco. One of el-Khayari's alleged offenses was to have opened a bank account in Melilla to deposit a payment of â,¬225 (US$288) paid to him by the Spanish daily El País for an article he wrote in 2006.

El-Khayari's alleged financial violations concern small sums of money and were not added to the charge sheet until the very end of the investigative phase of his case. This fuels suspicion that, whether substantiated or not, the filing of these charges was motivated by the authorities' desire to discredit him and to jail him for longer than the penalty allowed under the "gravely offending state institutions" charge.

That charge, as set forth in articles 263 and 265 of the penal code, carries a penalty of one month to one year in prison and a fine of 1,200 to 5,000 dirhams (US$144 to US$600).

At his trial, el-Khayari argued, unsuccessfully, that he had not offended "state institutions" as such, but, rather, had criticized individual state agents. As has been widely reported by the media, a number of officials are currently on trial for alleged complicity in drug-trafficking in the Rif.

Regardless of the facts in el-Khayari's case, laws that criminalize and provide prison terms for "gravely offending state institutions" are incompatible with international law governing the right to freedom of expression, which stress in particular the need to protect the freedom to criticize politicians and state authorities.

In addition to the three-year sentence, Judge Serhane fined el-Khayari about 753,000 dirhams (about US$90,360). El-Khayari, who is 30 years old, is being held at Oukacha Prison in Casablanca. Since his arrest, the court refused to provisionally free him, pending the trial. His lawyers said they plan to appeal the June 24 verdict.

"Today's harsh sentence against el-Khayari violates the basic right of freedom of expression, and the motive is to silence a leading human rights activist in the Rif region and to intimidate others," said Whitson.

Three year in jail to HR activist for contempt of authorities

Chakib Al Khayari a été condamné mercredi à 3 ans de prison ferme et à une amende de 753.930 DH au profit de l’administration des Douanes, par le Tribunal de première instance de Casablanca.

Président de l’Association Rif des droits de l’homme (ARDH), Al Khayari était poursuivi pour outrage aux autorités publiques et dépôt d’argent dans des banques étrangères.

Chakib Al Khayari avait été arrêté quelques jours après la diffusion sur la chaîne française M6 d’un reportage sur le trafic de drogue en partance de Nador dans lequel il dénonçait une certaine complicité des autorités marocaines.

Le président de l'Association Rif des droits de l'Homme, Chakib Khayari, poursuivi notamment pour "atteinte à corps constitués", a été condamné mercredi à trois ans de prison ainsi qu'à une lourde amende, a-t-on appris de source judiciaire. Chakib Khayari a été également condamné par le tribunal de première instance de Casablanca à verser aux douanes marocaines plus de 753.000 dirhams (68.000 euros).

Ce militant, connu pour ses positions antigouvernementales, était poursuivi pour "atteinte à corps constitués, infraction au code des changes et dépôt de fonds dans une banque étrangère sans l'autorisation" de l'Office des changes. Son arrestation, le 17 février à Casablanca, avait été annoncée par l'organisation américaine de défense des droits de l'Homme Human Rights Watch (HRW).

Selon l'agence de presse MAP, citant un communiqué du ministère de l'Intérieur, les déclarations de M. Khayari sur le démantèlement (le 13 janvier dernier) d'un réseau de trafiquants de drogue présumés à Nador (nord du Maroc) sont "dénuées de tout fondement". Le président de l'Association Rif des droits de l'Homme avait notamment déclaré que certaines des personnes impliquées dans ce réseau avaient pu "accéder à des postes importants au sein d'institutions de l'Etat", a-t-on également indiqué de même source.

Plus de 100 personnes ont été arrêtées et déférées devant le parquet de Casablanca dans le cadre de cette affaire.Parmi les prévenus figurent de nombreux fonctionnaires des services de sécurité. Ils sont accusés d'avoir exporté (ou aidé à exporter) plus de 30 tonnes de résine de cannabis vers la Belgique et les Pays-Bas via l'Espagne, avec la complicité présumée de gendarmes et d'éléments de la marine royale. La date de leur procès n'a pas encore été fixée.

Celui-ci était poursuivi pour outrage aux autorités publiques et dépôt de somme d’argent dans des banques étrangères sans autorisation de l’office des changes. Chakib Al Khayari été également soupçonné de percevoir des sommes d’argent de l’étranger pour mener une campagne médiatique sur les réseaux de drogue installés à Nador, au nord du pays, en omettant ceux de Ketama. Selon la thèse officielle rapporté par la MAP, il visait à discréditer et à nuire aux efforts déployés par les autorités marocaines dans la lutte contre le trafic de stupéfiants.

Chakib Al Khayari était connu pour ses positions antigouvernementales, il avait déclaré que certaines des personnes impliquées dans l’affaire du démantèlement d'un réseau de trafic de drogue à Nador, avaient pu accéder à des postes très importants au sein d’institutions de l’Etat. Quelques 109 personnes ont été arrêtées et déférées devant le parquet de Casablanca dans le cadre de cette affaire. Parmi les prévenus figurent de nombreux fonctionnaires des services de sécurité. Ils sont accusés d’avoir exporté ou aidé à le faire, plus de 30 tonnes de résine de cannabis vers la Belgique et les Pays-Bas via l’Espagne, avec la complicité présumée de gendarmes et d’éléments de la marine royale.

Ce verdict crée de vives protestations au sein des organisation des droits de l'Homme. Human Rights Watch (HRW) qui suit l’affaire depuis son déclenchement considère le jugement émis comme totalement infondé. Son directeur de recherche pour la région du Moyen-Orient et d'Afrique du Nord (MENA), Eric Goldstein, a déclaré dans des propos rapporté par Reuters, que "l’organisation est très déçue par ce verdict, et que cela vise tous les défenseurs des droits de l’homme dans la région du Rif". Pour la directrice de HRW MENA, Sarah Leah Whitson, "le Maroc s'est ouvert dans une certaine mesure. Mais le traitement de l'affaire Al Khayari montre que lorsqu'on se permet d'aborder les sujet qui fâchent les officiels, alors ils vous tombent dessus comme toute la misère du monde".

D'après Goldstein, les avocats de Khayari ont l'intention de faire appel contre la décision de la Cour. Affaire à suivre.

Waarom wordt er in de media zo weinig aandacht besteed aan de zaak van Chakib? In Marokko zelf heerst er nog steeds een duidelijke vorm van censuur, dus dat spreekt voor zich, maar hoe zit het dan met het buitenland. Het Vrije Westen met al haar grote nieuwszenders en krantenedities. De beschermers van de rechten van de mens en de vrijheid van meningsuiting toch? Toch ofniet...?  Is er dan niemand die durft op te staan voor Chakib en zijn stem te doen laten gelden?

Die mensen zijn er gelukkig wel degelijk! Zowel in Marokko als ver daarbuiten >

De reden dat het zogenaamde Vrije Westen en met name Amerika in de zaak van Chakib graag de andere kant op kijkt is dat Amerika waarschijnlijk een deal heeft gesloten met de Marokkaanse autoriteiten. Des Plaines pilot back home after more than a year in Moroccan prison

Morocco's King Mohammed VI pardons James Douglas Willson

James Douglas Willson is back in Des Plaines, 13 months after Moroccan police handcuffed him in the shadow of a small plane on a desolate road in the North African country.

Willson's captivity in a Moroccan prison on drug-trafficking charges ended abruptly last week when Morocco's King Mohammed VI pardoned him. Willson, 67, was convicted of drug trafficking and illegally entering the country after a Cessna 337 in which he was a passenger touched down in a remote region of Morocco in May 2008.

Moroccan officials said he was preparing to load drugs onto the plane in an area known as a jump-off point for taking narcotics to Europe. He was sentenced to 8 years in prison.

Willson, a retired pilot, said he was riding with the pilot as a favor to a friend who delivered the Cessna to Spain and wanted to ensure the man could use the equipment. The plane had trouble, and the pilot made an emergency landing, Willson said.

Jullie lezen het goed! Terwijl de Marokkaanse rechtbank deze week Chakib voor 3 jaar naar de gevangenis stuurt, besluit M6 de Amerikaanse gevangene genaamd James Douglas Willson (die nog 6 jaar had te gaan van zijn straf) een "pardon" te verlenen. Maw. een Amazigh moet de cel in en een Amerikaan mag naar huis. En de Amerikaanse en Marokkaanse media proberen dit bericht zo stilletjes mogelijk te houden.
